These Terms of Service ("Terms") govern your use of hadilcharm.com (the "Site") and every purchase you make through it. The Site is operated by HADILCHARM BRAND - FZCO, a free zone company registered in the United Arab Emirates, with its registered office at IFZA Business Park - Building A2 - Nadd Hessa - Dubai Silicon Oasis - Dubai, United Arab Emirates ("HADILCHARM", "we", "us", "our").
By browsing the Site or placing an order you accept these Terms together with our Privacy Policy, Shipping Policy and Refund Policy, which are incorporated into them. If you do not accept them, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you meet this requirement and that the information you give us is accurate and complete.
2. Our products and important health information
HADILCHARM sells coloured contact lenses and related accessories. Contact lenses are worn directly on the eye and must be treated with care.
- Consult an optometrist, ophthalmologist or other qualified eye care professional before wearing contact lenses for the first time, and follow their advice on fitting and suitability.
- Follow the wearing time, replacement schedule, cleaning and storage instructions supplied with the product.
- Never share lenses with another person, never wear a lens beyond its stated replacement period, and never wear lenses while you have an eye infection or irritation.
- If you experience pain, redness, unusual discharge or a change in your vision, remove the lenses immediately and seek medical advice.
Product descriptions on the Site describe appearance and design. They are not medical advice and are not a substitute for an examination by a qualified professional. We do not diagnose, prescribe or fit lenses.
3. Product presentation
We take care to describe and photograph our products accurately. Colours are shown on different eyes and rendered on different screens, so the shade you see on your own eye may vary from the images, and this variation is not a product fault. Packaging design may change from time to time.
4. Prices and currency
Our base prices are in UAE Dirham (AED). Prices are displayed in the selected currency, and the currency of your order is shown at checkout. Prices include any taxes applicable in the United Arab Emirates. Import duties and taxes in the destination country are not included — see our Shipping Policy. Shipping costs are shown separately at checkout before you confirm your order.
We may change prices, promotions and product availability at any time. The price that applies to your order is the one shown at the moment you confirm it. If a price or product detail is displayed incorrectly because of an obvious error, we may cancel the affected order and refund you in full; we will contact you first.
5. Orders and formation of the contract
Placing an order is an offer to buy. The order confirmation we send you acknowledges receipt but does not conclude the contract. The contract of sale is formed only when we dispatch the goods and send you a dispatch confirmation.
We may decline or cancel an order, in whole or in part, where the item is out of stock, where payment cannot be verified, where an obvious pricing or description error has occurred, where delivery to your address is not possible, or where we reasonably suspect fraud or a breach of these Terms. If we cancel an order for which you have already paid, we refund you in full.
6. Payment
Payment is due in full when you place your order, through the payment methods offered at checkout. Payments are processed by our payment providers; we do not store your card details. By submitting payment information you confirm that you are entitled to use the payment method concerned.
7. Shipping and delivery
Delivery times, shipping rates and the countries we serve are set out in our Shipping Policy. Delivery estimates are not guaranteed dates. Risk in the goods passes to you on delivery.
8. Returns, cancellation and refunds
Your right to cancel or return an order, and the hygiene restrictions that apply to opened lens packaging, are set out in our Refund Policy. Nothing in these Terms limits any statutory consumer right you have that cannot be excluded by law.
9. Accounts
If you create an account, you are responsible for keeping your login details confidential and for all activity that takes place under your account. Tell us immediately if you believe your account has been used without your permission. We may suspend or close an account that is used in breach of these Terms.
10. Intellectual property
The Site and its content — including the HADILCHARM name, logo, product names, text, photography, video, graphics, page design and code — are owned by HADILCHARM BRAND - FZCO or its licensors and are protected by copyright, trade mark and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, modify or use our content or branding for commercial purposes without our prior written consent.
11. Acceptable use
You agree not to use the Site for any unlawful purpose, not to attempt to gain unauthorised access to it or to any system connected to it, not to introduce malicious code, not to extract data by automated means such as scraping, and not to interfere with its normal operation or with other users. If you submit a review, comment or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it in connection with the Site and our marketing, and you confirm the content is yours to share and is not unlawful or offensive.
12. Third-party links
The Site may link to third-party websites and social media platforms. We do not control them and are not responsible for their content, products or privacy practices. Following such a link is at your own risk.
13. Availability of the Site
We aim to keep the Site available at all times but do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of it for maintenance, updates or business reasons without notice.
14. Limitation of liability
To the fullest extent permitted by applicable law, HADILCHARM is not liable for indirect, incidental, special or consequential loss, loss of profit, loss of data or loss of opportunity arising out of your use of the Site or of any product bought through it. Our total liability in connection with any order is limited to the amount you paid for that order.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. In particular, we do not exclude liability for injury caused by a defective product. We are not liable for harm resulting from a failure to follow the health guidance in section 2, the instructions supplied with the product, or the advice of an eye care professional.
15. Indemnity
You agree to indemnify HADILCHARM against claims, losses and reasonable costs arising from your breach of these Terms or your unlawful use of the Site.
16. Events beyond our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural events, epidemics, armed conflict, civil unrest, strikes, carrier or customs disruption, failures of communications networks, and acts of public authorities. If such an event materially affects your order, we will contact you and, where delivery is no longer possible, refund you in full.
17. Changes to these Terms
We may update these Terms from time to time. The version published on this page when you place your order is the version that applies to that order. The date of the most recent change is shown at the end of this page.
18. Severability and entire agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in force. These Terms, together with the Privacy Policy, Shipping Policy and Refund Policy, are the entire agreement between you and HADILCHARM in relation to your use of the Site and your purchases.
19. Governing law and jurisdiction
These Terms and any dispute arising out of them or out of a purchase made through the Site are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.
